HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.26409 of 2018 ORDER:

Heard Mr.P.Devender for petitioner and the learned Assistant Government Pleader for Revenue.

The petitioner prays for the following relief :- " ........ to issue a writ or direction preferably Writ of Mandamus declaring the action of the respondent Nos.2 to 6 and their subordinates in trying to dispossess the petitioner from his land in Sy.No.132/ 2/ 1 admeasuring Ac.0.11 Gts, Sy.No.132/ 3 admeasuring Ac.1.00 Gts, Sy.No.132/ 4 admeasuring Ac.0.31 Gts situated at Kampasagar village, Tripuraram Mandal, Nalgonda District, without issuing any notice, without initiating any proceedings by following due process of law is exfacie illegal, arbitrary and violative of principles of natural justice and violative of Art.14, 21 and 300-A of Constitution of India and consequently direct the respondent Nos.2 to 6 and their subordinates not to dispossess the petitioner from his land in Sy.No.132/ 2/ 1 admeasuring Ac.0.11 Gts, Sy.No.

132/ 3 admeasuring Ac.1.00 Gts, Sy.No. 132/ 4 admeasuring Ac.0.31 Gts situated at Kampasagar village, Tripuraram Mandal, Nalgonda District ....." The Assistant Government Pleader places on record the written instructions sent by 4th respondent. The operative portion of the written instructions reads as follows :- " ..... without issuing notice, without following the due procedure as required under law, no survey will be conducted and even in case any encroachment is noticed also, due procedure will be followed for eviction from the encroached and nothing will be done without following due procedure of law."

By accepting and placing the written instructions on record, the writ petition is disposed of accordingly. Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
