THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10764 of 2023 ORDER:
This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/accused seeking anticipatory bail in the event of his arrest in connection with Crime No.312 of 2023 on the file of Kandukur Police Station, Rachakonda Commissionerate, registered for the offence punishable under Section 306 of Indian Penal Code. 2.
Heard learned counsel for the petitioner/accused, learned Public Prosecutor representing the respondent-State and perused the record. 3.
The case of prosecution is that the deceased was in company of a girl. The petitioner had allegedly taken photographs of the deceased along with the said girl. Thereafter, he informed the deceased that he will send the said photos to his parents. Afraid of the said statement, the deceased poured kerosene on himself and lit fire resulting in his death. The statement was recorded by the police in the hospital. In the said statement, deceased informed that the petitioner is blackmailing him having taken photographs when he was going on a bike with a girl. 4.
As seen from the record, the petitioner had allegedly taken photographs of the deceased along with a girl and informed the deceased that he was going to send them to his parents. Except that, no act of abetment is attributed against the petitioner. In view of the
same, the petitioner/accused can be granted the relief of anticipatory bail, subject to the following conditions:
1) The petitioner/accused is directed to surrender before the Station House Officer, Kandukur Police Station, Rachakonda Commissionerate, within a period of seven days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner/accused on bail, on his executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty five Thousand only) with two sureties for a like sum each to his satisfaction.
2) On such release, the petitioner/accused shall appear before the concerned Station House Officer, on every Monday, for a period of eight(8) weeks between 10.00 A.M. and 1.00 P.M. and thereafter, as and when required for the purpose of investigation.
3) The petitioner/accused shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 6.
Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
