This appeal is directed against the order dated 20-07-2015 whereby Writ Petition No.20985 of 2015 filed by respondent No.1 has been disposed of with the direction to the appellant to consider the case of respondent No.1 as presented by them on 02-03-2015, pursuant to the order passed by the learned Principal Sessions Judge, Manabubnagar in Criminal Appeal No. 96 of 2014 dated 16-02-2015 and pass appropriate order for release of stock, if any, within a period of 30 days from the date of receipt of the order. We have perused the impugned order and the order dated 1602-2015 passed in Criminal Appeal No. 96 of 2014.
It appears that initially in the proceedings under Section 6-A of the Essential Commodities Act, 1955, an enquiry was conducted and the final order was passed on 19-11-2014 ordering confiscation of 20% of the seized stock worth Rs.10,00,345/-. That order was challenged in Criminal Appeal No. 96 of 2014 and in the appeal, the order was modified vide order dated 16-02-2015. The modified order has not been challenged by the appellant.
