HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 16308 of 2002 ORDER:

This writ petition is filed by the petitioner seeking to issue a writ of mandamus declaring the action of the respondent in not promoting him as post-graduate teacher in physical science, though he is discharging the said duties and was sent for orientation training, as illegal and arbitrary.

When the matter is taken up for hearing, it is noticed that at the time of filing of the writ petition, the age of the petitioner was 46 years and by now, he must have completed the age of superannuation and, therefore, the cause in the writ petition does not survive. It is also noticed that vide orders dated 29.08.2002, while admitting the writ petition, this Court directed the respondent to consider the case of the petitioner for promotion to the post of post-graduate teacher in physical science. In view of the same, no further orders are necessary in the writ petition. Therefore, the writ petition is closed.
