THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.28415 OF 2015 ORDER:

The petitioner was appointed as Fair Price Shop Dealer of Shop No.0402, Bejjanki village and Mandal, Karimnagar District.. While so, the shop was inspected by the Deputy Tahsildar (CS), Mahadevpur and submitted a report, dated 15-06-2015 to the 2nd respondent alleging some variations in the stock.

Based on the same, Section 6-A proceedings were issued and they are pending. However, the 2nd respondent issued a show cause notice in respect of the same allegations as to the variations in the stock and issued suspension of authorization order, dated 17-07-2015.

Challenging the same, the present writ petition is filed.

A perusal of the order of suspension indicates that PDS Rice was less to an extent of 2.67 kgs. and Sugar Packets were less to an extent of 30 and the show cause notice does not say with regard to opening balance or supply made in order to verify whether variation comes within the permissible limit or not. In the circumstances, the order of suspension is vitiated and accordingly, set aside. However, the 2nd respondent is directed to proceed with the enquiry by giving due opportunity to the petitioner and pass final orders thereon within a period of 3 months from the date of receipt of a copy of this order. 3.
