THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.3125 OF 2016 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Revenue.
The petitioners are aggrieved by the action of the Tahsildar, Yellareddypet Mandal, Karimnagar District, the 4th respondent, in deleting their names and incorporating the name of the 5th respondent in the revenue records and the pahanies in respect of the subject lands situated at Thimmapur Village, Yellareddypet Mandal, Karimnagar District. On the petitioners application dated 08.04.2015 filed before the 4th respondent, an error occurred and the same was rectified and their names were restored by the proceedings of the 4th respondent under the Right to Information Act bearing No.B/165/2015, dated 05.05.2015. The petitioners however complain that hardly within a month thereafter again the name of the 5th respondent is incorporated in the pahani by deleting their names. Aggrieved thereby, the petitioners straight away filed the present Writ Petition.
Apparently, the petitioners have not brought the said change of names to the notice of the 4th respondent. Hence, the Writ Petition directly filed against the entries in the revenue records cannot be entertained. However, the petitioners are at liberty to file appropriate application before the 4th respondent, who shall examine the same expeditiously and do the needful after notice to the petitioners and the 5th respondent.
The Writ Petition is accordingly disposed of. There shall be no order as to
costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
