THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40055 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to call for the records from the 2nd respondent in FIR No.432 of 2016 registered under Sections 427 & 448 IPC and to quash the same. The allegations of the present complaint lodged by the 3rd respondent against the petitioners are that the 3rd respondent was working as Electrician in the petitioners' hospital since 35 years and he was provided a room in the year 1984 and since then, he was living peacefully with his wife and children and his mother. Later, on 05.06.2016, the management of the hospital forcefully said to vacate the room and on 01.11.2016 at about 16.00 hours, while the 3rd respondent and his family was in the room, the security forcefully pulled them out of the room.

The grievance of the petitioners is that the alleged complaint made against the petitioners is a civil dispute and that the action of the 2nd respondent on the complaint made by the 3rd respondent amounts to abuse of process of law and causes grave injustice to the petitioners. Considering the grievance of the petitioners, the 2nd respondent is directed to complete the investigation in FIR No.432 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed.
