Heard.

The grievance of the petitioners is that by virtue of the order of the 3rd respondent in Case No.B1/3154/2012, dated 17-08-2013, the matter was remitted to the 4th respondent for fresh consideration, after examining the record. But till date, the 4th respondent has not fixed the date of hearing nor has heard and complied with the directions of the 3rd respondent.

It is evident that the 4th respondent has addressed a letter to the 2nd respondent on 20-02-2014 seeking clarification from the 2nd respondent and in response thereto, the 2nd respondent vide his Lr.No.E4/796/2014, dated 30-06-2014, directed the 4th respondent to take necessary action and exercise powers as quasi judicial authority, after giving an opportunity to the petitioners and after examining their contentions in detail. In spite of the said letter of the 2nd respondent, no further steps are taken by the 4th respondent.

In view of that, I deem it appropriate to direct the 4th respondent to fix an early date of hearing, hear the parties concerned, examine the record and comply with the directions of the 3rd respondent, referred to above. Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date: 16-09-2015
