M. Mogulaiah, Medak Dist. v. Ch. Mogulaiah, Medak Dist., And 5 Otrs.
HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI AND HON'BLE SRI JUSTICE PULLA KARTHIK W.P.No.20788 OF 2014 ORDER: (Per Hon'ble Sri Justice Abhinand Kumar Shavili) When the matter is taken up for hearing, it is noticed that during pendency of the writ petition, the petitioner has retired from service on attaining the age of superannuation. A perusal of the record discloses that the Tribunal never granted any adverse relief against the petitioner and the Tribunal has only directed that the contesting respondent should be promoted as Superintendent on par with the petitioner. We are unable to understand how the petitioner was aggrieved by the order passed by the Tribunal and filed the present writ petition.
Since the petitioner has retired from service, the cause in the writ petition does not survive for adjudication and accordingly, the Writ Petition is dismissed as infructuous. No costs.
Miscellaneous petitions, if any, pending shall stand closed.
