THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10793 of 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime No.819 of 2023, on the file of P.S., Raidurgam, Cyberabad, registered for the offences punishable under Sections 370, 370(A)(2) of the Indian Penal Code (for short 'IPC') and Sections 3, 4 and 5 of the Immoral Traffic (Prevention) Act, 1956.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

Briefly, the facts of the case are that the Police, Raidurgam police station raided the premises in Flat No.2109 of Lanco Hills, Manikonda, Gandipet and found that the petitioner was the organizer and running prostitution in the said premises. Seizures were made in the said room and the police found that there was a lady found in the bed room participating in sexual intercourse with the customer.

Learned counsel for the petitioner would submit that the petitioner has nothing to do with the alleged prostitution being run in the premises and the police have falsely implicated him. He further submits that Section 370 of IPC is punishable up to seven (7) years.

Keeping in view that there are no criminal antecedents against the petitioner and also since the petitioner has been in jail from 04.10.2023, the relief of regular bail is considered subject to the following conditions:

i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of the XIII Addl. Metropolitan Magistrate, Cyberabad at Rajendranagar.

ii) The petitioner/Accused No.1 after release shall appear before the concerned Station House Officer on every Monday, Wednesday and Saturday at 10am for a period of four (04) weeks and thereafter, as and when required, for the purpose of investigation. iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
