THE HONOURABLE SRI JUSTI CE A.V.SESHA SAI W r it Pet it ion No.2 6 3 0 4 of 2 0 1 8 ORDER:

Heard learned Counsel appearing for the petitioner and Sri L.Venkateshwar Rao, the learned Standing Counsel for respondent-Municipal Corporation.

The only grievance of the petitioner in the present Writ Petition is that despite the submission of the explanation, dated 22.03.2018, in response to the notice, dated 17.03.2018, issued under Section 461 of the HMC Act, 1955, the respondentauthorities, without passing any further orders on the said explanation, are trying to demolish the subject structures. Recording the said submission, this Court deems it appropriate to dispose of the Writ Petition, directing the respondent-authorities to verify the explanation, dated 22.03.2018, said to have been submitted by the petitioner herein in response to the notice, dated 17.03.2018, and pass appropriate Orders on the said explanation, strictly in accordance with law. Till such exercise is finalized, no coercive action pursuant to the impugned notice, dated 17.03.2018, with regard to the subject structures shall be taken.

Miscellaneous petitions pending, if any, shall stand disposed of. There shall be no order as to costs. ___________________________ JUSTI CE A.V.SESHA SAI Date: 27.07.2018 smr
