THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY Civil Revision Petition No.1804 OF 2015 ORDER:

Aggrieved by the non-disposal of OS.No.35/2010 which is pending before the I Additional District Judge, Kurnool, the Civil Revision Petition is filed.

It is stated in affidavit that though the suit is posted for crossexamination of PW1, on several occasions matter underwent several adjournments. As such, on 19.06.2015, this Court passed an order calling for a report from the concerned Court as to why the suit is being adjourned several times.

In pursuance to the same, report dated 30.06.2015 is filed stating that on 18.10.2012, IA.No.1584 of 2012 was filed praying to mark the Xerox copy of the 'Will' dated 14.02.2003 and the same was disposed of on 28.04.2013. Aggrieved by the said order the respondent No.1 filed CRP.No.818/2014 before this Court. Since the same is pending before this Court, the Court below could not taken up OS.No.35/2010 for some time. It is also stated that since the regular officer retired from service on 30.04.2015, the Judge, Family Court-cum-IV Addl.District Judge, Kurnool was kept in-charge of I Addl. District Judge, Kurnool, with effect from 01.05.2015.

In view of the above facts and circumstances, since the suit is of the year 2010, the trial Court is directed to dispose of the suit in OS.No.35/2010 as expeditiously as possible.

With the above direction, this Civil Revision Petition is disposed of. There shall be no order as to. As a sequel thereto, miscellaneous petitions, if any, pending in this Civil Revision Petition shall stand closed. ______________________________ A.RAJASHEKER REDDY, J 10.07.2015
