THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9298 of 2016 ORDER:

The criminal petition under Sections 437 and 439 of the Code of Criminal Procedure is filed by the petitioner/A.1 seeking bail in Crime No.103 of 2016 on the file of the Shamshabad P.S., registered for the offences under Sections 448, 323, 506 read with 34 IPC and Section 3(1)(i)(n)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

When the case is taken up for hearing, this Court observed that the Registry prepared a note as to maintainability of the criminal petition as the petitioner has approached this Court without approaching the lower Court concerned as the lower courts are continuously boycotting, and that the said objection taken by the Registry is sustained. However, the Registry inadvertently numbered the criminal petition and the same is listed before this Court. Hence, the criminal petition is liable to be dismissed.

The criminal petition is accordingly dismissed. Miscellaneous applications, if any pending in this criminal petition, shall stand dismissed.
