THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2165 OF 2015 ORDER:

The present criminal revision case is filed by the petitioner challenging the order, dated 07.08.2015, passed in Criminal Appeal No.125 of 2015 by the Court of the Principal Sessions Judge, Kurnool, whereby the learned District Judge partly allowed the appeal reducing the interim maintenance of Rs.20,000/- (Rupees twenty thousand only) from Rs.40,000/- (Rupees forty thousand only) payable by the petitioner herein to the second respondent and her daughter, as ordered by order, dated 18.06.2015, in Crl.M.P.No.925 of 2015 in D.V.C.No.18 of 2014. Heard and perused the records.

Learned counsel for the petitioner submitted that the petitioner herein is unable to pay the interim maintenance amount of Rs.20,000/- (Rupees twenty thousand only) per month to the respondent No.2 and her daughter as ordered by the Court below and as such, prays this Court to reduce the maintenance amount. Considering the facts and circumstances of the case, the criminal revision case is disposed of with the following directions.

(i) The petitioner herein is directed to pay 50% of the interim monthly maintenance ordered by the lower appellate Court, i.e., Rs.10,000/- (Rupees ten thousand only) to the second respondent and her daughter payable on or before 10th of every succeeding month;

(ii) The petitioner is also directed to pay the arrears of maintenance amount calculating at 50% of the maintenance amount ordered by the Court below, within a period of three months from the date of this order; and (iii) The trial Court is directed to dispose of D.V.C.No.18 of 2014 as expeditiously as possible, preferably within a period of six months, without being influenced by the order of this Court.

With the above directions, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed.
