THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.26298 of 2018 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleaders for Excise and Home, appearing for the respondent Nos.1 to 3 respectively.

It is stated by the Counsel on both sides that the issue raised in this Writ Petition is covered by the Order, dated 20.12.2017, in W.P.No.43388 of 2017.

Therefore, for reasons alike, this Writ Petition is also disposed of directing the petitioner to make an appropriate application before the Deputy Commissioner of Prohibition and Excise, Warangal-second respondent, enclosing thereto a Fixed Deposit Receipt for Rs.1,00,000/- (Rupees one lakh only) drawn in favour of the second respondent on any nationalized bank; and on such application being made by the petitioner, the subject stock i.e.,200bags of black jaggery each containing 50 Kgs., seized in C.O.R.No.81 of 2018 on the file of the 3rd respondent herein, shall be given to the interim custody of the petitioner. No order as to costs.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed.
