THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.8499 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India challenges inaction on the part of the 2nd respondent-District Collector in passing orders on the appeal, dated 02.11.2015, said to have been filed by the petitioner herein against the order of removal passed by the 3rd respondent on 23.10.2015.

2. Heard Sri L.J.Veera Reddy, learned counsel for the petitioner, learned Government Pleader for respondents 1 and 2 and Sri M.S.R.Chandra Murthy, learned Standing Counsel for respondent No.3.

3. The petitioner herein is appointed as a Field Assistant for Thativaripalem Gram Panchayat, Marturu Mandal, Prakasam District under Mahatma Gandhi National Rural Employment Guarantee Scheme in the year 2006. Followed by a show cause notice, dated 05.05.2015, and submission of explanation by the petitioner, the 3rd respondent passed an order on 23.10.2015 terminating the petitioner from service. Aggrieved by the said order of termination passed by the 3rd respondent, petitioner herein filed an appeal before the 2nd respondent-District Collector on 02.11.2015.

4. Grievance of the petitioner is that no orders have been passed on the said appeal. Having regard to the nature of controversy and facts and circumstances of the case, this Court is of the considered opinion that the ends of justice would be met if 2nd respondent is directed to pass appropriate orders on the appeal, dated 02.11.2015, filed by the petitioner herein against the order of termination, dated 23.10.2015, by fixing some timeframe

For the aforesaid reasons, the Writ Petition is disposed of, directing the 2nd respondent-District Collector to pass appropriate orders on the appeal, dated 02.11.2015, filed by the petitioner herein against the order of termination passed by the 3rd respondent on 23.10.2015, within a period of two months from the date of receipt of a copy of this order in accordance with law. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
