Sri M Malla Reddy S/o Balaiah Aged 54 Years Occ ExSchool Assistant Maths Government High School Sarangapur The then Karimnagar District Presently Jagityal District Telangana State R/o 19455 College Road Mancheryal 504 208 Mancheryal Petitioner And The Government of Telangana Rep by its Principal Secretary Secretary Education Department Secretariat Hyderabad T S Hyd & another Respondents The Court made the following:
ORAL ORDER:
Petitioner was working as School Assistant (Maths) in Government service having joined service on 16.8.1997. He submitted resignation from service on his own, which was accepted. Therefore, he ceased to be Government employee from 30th Sept, 2013. Petitioner now seeks that he is in dire necessity of public employment, therefore, he should be reinstated into service.
2.
It is not in dispute that petitioner voluntarily resigned from service and same was accepted and he ceased to be employee of the Government. Learned counsel for petitioner has also not brought to the notice of this Court any Rule or instruction which enables an ex-employee to seek reemployment having terminated the services voluntarily by submitting a resignation. 3.
There is no provision which enables a person who has resigned from service to be re-inducted to the service. When there is no provision, relief sought for by the petitioner to induct into service on the ground that he is in dire financial need and is suffering due to loss of employment, cannot be a ground to grant the relief as prayed.
4.
The writ petition is misconceived and accordingly the same is dismissed. No costs.
Miscellaneous petitions, if any pending, are closed. __________________ P NAVEEN RAO,J DATE: 03-08-2018 TVK
