THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.164 OF 2014 ORDER:

The present criminal revision case is filed by the petitioner challenging the order, dated 19.03.2012, passed in M.C.No.4 of 2011 by the Court of the Additional Judicial First Class Magistrate, at Sangareddy, whereby the Court below directed the petitioner herein to pay a sum of Rs.3,000/- per month to the first respondent herein towards maintenance.

Heard and perused the material available on record. The main grievance of the petitioner is that the first respondent/wife is also earning an amount of Rs.10,000/- per month by working as Accountant in an educational institution. Though the petitioner stated that the first respondent is educated and earning, he could not substantiate the said submission by producing any document or salary certificate either before the Court below or before this Court. Further, the leaned counsel for the petitioner submits that the petitioner is earning only Rs.10,000/- per month and as such, directing to pay an amount of Rs.3,000/- to the first respondent is excessive in nature and as such, prays this Court to reduce the said maintenance amount.

It is evident from the record that the trial Court has passed an order directing the petitioner herein to pay an amount of Rs.3,000/- to the first respondent including their son. Hence, it cannot be said that the said amount is excessive in nature. The order of the Court below is in accordance with law and as such, this Court is not inclined to interfere with the well considered order of the Court below.

The Criminal Revision Case is dismissed. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO 06.11.2015 pln
