HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.30791 of 2015 ORDER:

When the matter is taken up for hearing, learned counsel appearing for the petitioner submits that the petitioner has submitted a representation to the respondents on 22.05.2015 requesting to appoint him as Village Servant in terms of G.O.Ms.No.1849 dated 28.10.2005 and G.O.Ms.No.39 dated 11.02.2008 and therefore, appropriate orders be passed in the writ petition directing the respondents to consider the case of the petitioner as and when the respondents fill up the post of Village Servant.

The learned Government Pleader appearing for the respondents submit that whenever there are vacancies in the cadre of Village Servant, the respondents will issue notice calling for the applications for the post of Village Servant and the case of petitioner would be considered, if he responds to the said notice. This Court, having considered the rival submissions of the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the case of the petitioner, if he is otherwise eligible, in accordance with the Rules as and when they undertake the exercise of filling up vacant post of Village Servant, provided that the petitioner responds to the notice issued by the respondents. With the above observations, the writ petition is disposed of. No order as to costs.
