Sri Mohammed Anwarullah Ali, v. The Commissioner,
HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 35082 of 2012 Order:
The petitioner states that he purchased 1000 sq. yards of land with a house bearing No.8-14-143/A3, situated at Shastripuram Cooperative Society, Mailardevpally village, Rajendranagar Mandal, Ranga Reddy District from one Aslam Bin Asim and two others through an Agreement of Sale-cum-GPA dated 02.06.2007 for a valuable consideration. The said vendor in turn purchased the same under a registered sale deed dated 25.09.2005. The petitioner states that he has been in possession of the said property since the date of purchase and has been paying house tax also. While so, on 02.11.2012 the second respondent along with his subordinates came to his house and made attempts to demolish the existing structures. In those circumstances, he filed the present Writ Petition challenging the action of the respondents in trying to dispossess him from the property.
This Court, while issuing notice before admission on 09.11.2012, granted status quo to be maintained by both the parties. Even after four years, no counter affidavit is filed by the respondents. Today, when the case is taken up, none appeared for the respondents. In the circumstances, this Court has no other alternative except to dispose of the Writ Petition with a direction to the respondents not to interfere with the property of the petitioner except in accordance with law. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
