HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10235 OF 2015 O R D E R :

This petition is filed for issuance of a writ of Mandamus declaring the inaction of the 3rd respondent in not issuing the 'No-Objection Certificate(NOC)' from Fire Department even though payment was made by the petitioner institution on 02.02.2015, as illegal and arbitrary and consequently to direct the 3rd respondent to issue 'No-Objection Certificate(NOC)'

The case of the petitioners-institutions is that they were approved by the 1st respondent by granting affiliation further to the recognition granted by National Council for Teacher Education for the previous academic year 2013-14 and they were also granted recognition for the current academic year 2014-15. Because of compellment of 'No-Objection Certificate(NOC)' from Fire Department, the petitioners filed W.P.No.5170 of 2015 and this Court on 03.03.2015 while issuing notice before admission, granted direction permitting the petitioners-institutions to submit 'No-Objection Certificate(NOC)' from Fire Department on or before 31.03.2015. Hence, the petitioners-institutions made an application on 02.02.2015 by paying requisite fee, but no action has been taken so far. Aggrieved by the same, this writ petition is filed.

Heard the learned counsel for the petitioners, learned Government Pleader for School Education, appearing for respondent Nos.1 and 2 and Sri P.Krishna Reddy, learned Standing Counsel appearing for respondent No.3. The representation of the petitioners dated 02.02.2015, which is made pursuant to the directions of this Court, is pending before the 3rd respondent for grant of 'No-Objection Certificate(NOC)' the 3rd respondent is directed to dispose of the said representation, within a period of three weeks, in accordance with law, from the date of receipt of a copy of this order.

Accordingly, this writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand

closed.
