THE HON'BLE SRI JUSTICE A. V. SESHA SAI WRIT PETITION No.9379 OF 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"...to Issue an appropriate writ, or order or direction more particularly one in the nature of writ of mandamus declaring that that the order No: P1/469(4)/2015-CPT dated 15.12.2015 retiring the petitioner on medical grounds is arbitrary, unjust, contrary to Section 47(1) of the Persons with Disabilities Act, and Circular No.PD-35/2015 dated 04.12.2015, discriminatory and in violation of Article 14 and Article 21 of the Constitution of India, set aside the same and consequently (Effect the Respondents to direct the petitioner to Medical Board for re-medical examination for continuing in the post of Assistant Depot Clerk, with all consequential benefits including payment of salary, in the interest of justice and fair play and pass such other order or orders just and necessary in the circumstances of the case."

2. Heard Sri A.G. Satyanarayana Rao, learned counsel for the petitioner, and Sri A. Rama Rao, learned Standing Counsel for the respondents.

3. When the matter is taken up, it is submitted by the learned counsel for the petitioner that for redressal of his grievance, the petitioner submitted a representation dated 21.12.2015 to the 3rd respondent and no orders have been passed on the said representation. It is however requested by the learned counsel for the petitioner that the 3rd respondent may be directed to pass appropriate orders on the representation within a time frame.

4. The said request is not opposed by the learned Standing Counsel for the respondents.

5. Hence, the writ petition is disposed of, without expressing any

opinion on the merits and demerits of the matter, directing the 3rd respondent to pass appropriate orders on the representation dated 21.12.2015 said to have been submitted by the petitioner within four weeks from the date of receipt of a copy of this order as per law. There shall be no order as to costs.

6. The Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
