HONOURABLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.1909 of 2015 ORDER:

This revision is filed against the order, dated 1308-2015 passed in Crl.M.P.No.409 of 2014 in M.C. No.11 of 2014 on the file of the Family Court-cum-IV Additional District & Sessions Court at Vijayawada. Respondent Nos.1 to 3 filed the above application viz., Crl.M.P.No.409 of 2014 claiming interim maintenance at the rate of Rs.15,000/- per month to the Respondent No.1 and Rs.10,000/- per month each to the Respondent Nos.2 and 3 on the ground that the petitioner neglected to look after them. The Court below granted interim maintenance of Rs.10,000/- per month to the Respondent No.3 only. Aggrieved by the same, the petitioner filed the present revision.

Heard and perused the material available on record.

Having regard to the facts and circumstances of the case, without expressing any opinion on the merits of the case, this Criminal Revision Case is disposed of modifying the order under revision as follows:

The petitioner is directed to pay maintenance at the rate of Rs.5,000/- per month to the Respondent No.3 from the date of the above Crl.M.P. and he is also directed to pay the maintenance at the same rate on or before 10th of every succeeding month till the disposal of M.C. and he is also directed to pay the arrears of maintenance, if any, at the same rate within three months from today. The trial Court is directed to dispose of the M.C. within a period of three months from the date of receipt of a copy of the order without being influenced by this order and the order under revision.

Accordingly, the Criminal Revision Case is disposed of. Consequently, miscellaneous petitions pending, if any, in this revision are closed. ______________________ JUSTICE RAJA ELANGO Dated: 08.09.2015 skmr
