THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.10795 OF 2023 ORDER:

The Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.2 in Crime.No.791 of 2023 on the file of Chandanagar Police Station, Cyberabad, registered for the offences under Section 8(c) r/w. 22(c) and 27 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act').

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The Chandanagar, Sub-Inspector of Police apprehended five accused. The petitioner herein is arrayed as A-2. It is stated in the remand report that 5gms of MDMA drug was seized from A-2.

Learned counsel for the petitioner would submit that the petitioner is a student and there are no other cases

pending against this petitioner. The contraband seized from this petitioner is less than the commercial quantity. 5.

On the other hand, learned Assistant Public Prosecutor would submit that the Police need time to investigate and the petition has to be dismissed at this juncture. However, he does not dispute that there are no other cases pending against this petitioner.

Keeping in view that the contraband seized is less than the commercial quantity and the petitioner being a student, he can be granted the relief of regular bail on the following stringent conditions:- i) The petitioner/Accused No.2 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties, for a like sum each to the satisfaction of the Metropolitan Sessions Judge, Ranga Reddy District at L.B.Nagar. ii) The petitioner/Accused No.2 after release shall appear before the concerned Station House Officer at 10:00 a.m. everyday for a period of three weeks and thereafter, as and when required for the purpose of investigation.

iii) The petitioner/Accused No.2 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
