This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners who are arrayed as Accused Nos.1 to 3 in Crime No.92 of 2022 pending on the file of Station House Officer, Shantinagar Police Station, Jagulamba-Gadwal District registered for the offence punishable under Sections 304-B and 498-A of Indian Penal Code and Sections 3, 4 and 6 of Dowry Prohibition Act.

Heard learned counsel for the petitioners/Accused and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The present crime was registered on the basis of the complaint lodged by the mother of the deceased stating that the 1st petitioner/Accused No.1 was married to her daughter on 15.05.2019 and at the time of marriage an amount of Rs.5,00,000/- cash was given along with other jewellery ornaments. However, five months after the marriage, the petitioners started demanding
for additional dowry of Rs.20,00,000/- to set up a poultry farm. For the said reason of continuous harassment, the wife of Accused No.1 consumed pesticide on 28.07.2022 resulting in her death on 29.07.2022. The petitioners were arrested on 01.8.2022. 4.
On instructions learned Assistant Public Prosecutor would submit that ten witnesses were already examined and the investigation is pending.

Keeping in view the allegations against the petitioners are in between the spouses and that the investigation is almost complete, the prayer for regular bail can be considered on conditions. 6.
Accordingly, the Criminal Petition is allowed and the petitioners/Accused No.1 to 3 are granted bail subject to the following conditions:
i) The petitioners/Accused Nos.1 to 3 are directed to be released on bail on their executing personal bonds for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties each for a like sum to the satisfaction of First Class Magistrate at Gadwal.
ii) After release on bail, the petitioners/Accused Nos.1 and 3 shall appear before the concerned Station House Officer on every Monday between 10.00 A.M to 1.00 P.M, for a period of twelve (12) weeks or until filing of charge sheet, whichever is earlier and the petitioner/Accused No.2 shall appear before the investigating authorities as and when required.
iii) The petitioners/Accused Nos.1 to 3 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 11.10.2022 ns
