Respondents Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus, by declaring the action of the respondents capricious in not considering the tender submitted by the petitioners along with other eligible tenderers pursuant to the RFP Tender Notice NIT No.71/SC(CZ)/GHMC/T4/2014-2015 dated 4.2.

2015 as being arbitrary, illegal, discriminatory amounting to colourable exercise at power, and in violation of Article 14 of the Constitution of India and consequently hold that the petitioners are entitled to participate and be awarded the contract pursuant to the RFP Tender Notice NIT No. 71/SC(CZ)/ GHMC/T4/2014-2015 dated 4.2.2015. The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and orders of the High Court dated 11-03-2015, 13-03-2015 and 19-03-2015 made herein and upon hearing the arguments of Smt. Y. Jhansi, Advocate for the Petitioner and Sri R.
