THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.1377 OF 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

As permitted by this Court in W.P.No.10047 of 2014, dated 03.04.2014, the petitioner made an application to the District Collector, Krishna at Machilipatnam, the 2nd respondent, through Mee-Seva on 28.12.2015 seeking permission to alienate the assigned land admeasuring Ac.1.98 cents in R.S.No.813/3 of Nidimolu Village, Movva Mandal, Krishna District. The petitioner states that prior to that also, she made requisite application as early as on 05.01.2014 but the matter remains pending with the 2nd respondent and no further orders are passed as on today. The petitioner claims to be a widow, aged about 71 years.

She states that her husband was an Ex-serviceman and was assigned land and moratorium period of ten years has long expired and on the ground that she is suffering from ill health and admitted in Manipal Hospital, Vijayawada, she intends to dispose of the subject property for her medical assistance. In these circumstances, the 2nd respondent is directed to consider the application, dated 28.12.2015, of the petitioner on its own merits and communicate appropriate decision within three months from the date of receipt of a copy of this order.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall

stand closed.
