THE HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD M.A.C.M.A.NOs.2962 of 2009 & 1359 OF 2010 COMMON JUDGMENT:

These appeals arise out of order and decree, dated 24.02.2009 in O.P.No.630 of 2007 passed by the Chairman, Motor Vehicle Accident Claims Tribunal-cum-I Addl. District and Sessions Judge, R.R. District at L.B. Nagar, Hyderabad. 2.

Petitioners-claimants are the legal representatives of the deceased-A.Srinivasa Murthy. They filed the application under Section 166 of the M.V. Act claiming compensation of Rs.25,11,147/- on account of the death of the deceased in a motor vehicle accident.

The Tribunal on consideration of evidence, passed an award granting compensation of Rs.7,12,000/- with interest at 7.5% p.a.

Having dissatisfied with the award passed by the Tribunal, claimants preferred MACMA No.2962 of 2009 and the Insurance Company preferred MACMA No.1359 of 2010. 5.

In both these appeals, the common point that arises for consideration is whether the quantum of compensation awarded by the Tribunal is just and reasonable?

Learned counsel for the petitioners-claimants in MACMA No.2962 of 2009 filed MACMA MP No.634 of 2012 for receiving some additional evidence. The said petition is allowed today and the documents are received in this Court. However, the documents can be marked only through the witnesses concerned.

Therefore, the trial Court is directed to get the documents marked through the witnesses subject to proof and relevancy and dispose of O.P. within a period of 3 months from the date of receipt of a copy of this judgment. Both the parties are directed to co-operate for disposal of the O.P.

With this direction, both the appeals are disposed of. No order as to costs. Miscellaneous petitions, if any pending in these appeals shall stand closed.
