Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner applied for grant of licence in respect of Liquefied Petroleum Gas distributorship and the same was granted in the year 2003. While so, the licence of the petitioner was suspended by the third respondent by proceedings dated 30.01.2017 with effect from 14.01.2017 pending further action to be taken under Clause 28(1) of the Andhra Pradesh Petroleum Products (License and Regulation of Supplies) Order 1980. Challenging the same, the petitioner preferred an appeal on 09.02.2017. When the said appeal was pending, a final order was passed on 10.03.2017 by the third respondent. Challenging the said final order the petitioner filed another appeal on 15.03.2017 before the second respondent and, when no orders were passed in the said appeal, the present Writ Petition is filed.

However, in view of the subsequent order dated 10.03.2017, the appeal dated 09.02.2017 has become infructuous. Hence, the second respondent has to consider the appeal dated 15.03.2017 preferred against the order dated 10.03.2017 passed by the third respondent. Since it is a statutory appeal preferred before the second respondent, this Writ Petition is disposed of directing the second respondent to consider the said appeal and pass appropriate orders in accordance with law after giving opportunity to the petitioner within a period of four (4) weeks from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
