Yetti Rajababu And Another, v. The Integrated Tribal Dev. Agency,
THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.14311 OF 2010 Dated:20.02.2018 Between:
Yetti Rajababu, S/o Late Sanyasi, Aged 40 years, working as Vidya Volunteer, Mini Gurukulam, Jangalapalli, Wazeedu Mandal, Khammam District and another .. Petitioners And The Integrated Tribal Development Agency, rep., by its Project Officer, Bhadrachalam, Khammam District .. Respondent The Court made the following:
THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.14311 OF 2010 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Social Welfare appearing for the respondent.
2.
Petitioners were initially engaged as Vidya Volunteers and subsequently that designation was changed to Part Time Residential Teachers. This Writ Petition is filed challenging a news item published in Sakshi Telugu Daily Newspaper dated 02.06.2010, whereunder applications were called for filling up the posts of Part Time Teachers and contending that as the petitioners are already working on part time basis, they cannot be replaced by any part time employee and their services can be continued. 3.
This Court, by order dated 23.06.2010, directed the respondents to continue the petitioners as Vidya Volunteers at Mini Gurukulam, Jangalapalli, Wazeedu Mandal, Khammam District.
4.
Learned counsel for the petitioners submits that the 1st petitioner worked up to 2014 and the 2nd petitioner is working as of now.
5.
As can be seen from the relief sought, petitioners were aggrieved by the news item published in Sakshi Telugu Daily newspaper calling for applications for Part Time Teachers. As fairly submitted by learned counsel for the petitioners, pursuant to the interim direction, dated 23.06.2010, the posts
occupied by the petitioners were not filled up. Thus, the cause of action in the Writ Petition does not survive as recruitment was not taken up insofar as two posts occupied by the petitioners. 6.
The Writ Petition is accordingly disposed of. However, petitioners are granted liberty to agitate, if any adverse decision is made against them or any fresh part time recruitment is taken up. There shall be no order as to costs.
Miscellaneous Petition, if any, filed in this Writ Petition shall stand closed.
