O R D E R

The claim of the petitioner is that he is the owner of the subject property under two registered sale deeds and that when the neighbours are interfering with his possession, he filed suit and the civil court granted interim injunction and the same is subsisting as on today. Now the grievance of the petitioner is that the respondent - Municipal Corporation is contemplating to lay road in the subject property without following the due process of law.

The learned Standing Counsel for the respondent - Corporation on instructions submit that there was proposal to lay road in the year 2013 and as on today there is no such proposal and the authorities of the respondent are not interfering with the possession of the petitioner over the subject land. In view of the facts and circumstances and the submission of the learned Standing Counsel for the respondent - Corporation, the writ petition is disposed of at the stage of admission, directing the respondent not to interfere with the possession of the petitioner over the subject land, except in accordance with law.

It is made clear that if the petitioner has still has any grievance, he is at liberty to file a complaint with specific names and the Commissioner of the respondent - Corporation shall take appropriate action in accordance with law.

No order as to costs.
