THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.42821 of 2015 ORDER :

Heard counsel for the petitioner and the Government Pleader for Civil Supplies appearing for respondents.

2. It is not disputed that 4th respondent had issued a show cause notice to the petitioner mentioning certain charges on 13.08.2015.

3. Although counsel for the petitioner asserts that the petitioner did submit an explanation thereto, the Government Pleader for Civil Supplies on instructions states that no such explanation has been submitted by the petitioner and that was why, the impugned order suspending the petitioner's Fair Price Shop Dealership authorization was passed on 10.12.2015.

4. However, both counsel for petitioner and the Government Pleader for Civil Supplies state that the petitioner had submitted an explanation on 29.12.2015 to the impugned suspension order, which also gave an opportunity to the petitioner to submit an explanation within 15 days.

5. In this view of the matter, the Writ Petition is disposed of directing the 4th respondent to consider the petitioner's explanation dt.29.12.2015; conduct an enquiry as contemplated under Sub-Clause

(5) of Clause(5) of A.P. State Public Distribution System (Control) Order, 2008; and pass appropriate orders on or before 10.03.2016. There shall be no order as to costs.

6. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
