HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 3994 of 2017 Order:
This Writ Petition was filed challenging the action of the second respondent in not registering a case in spite of lodging a complaint on 08.01.2017 and 18.01.2017.
Now, a counter affidavit is filed, wherein it was admitted that the petitioner sent a complaint by post on 23.01.2017 and a GD entry was made on the basis of the said complaint on 23.01.2017 itself. The preliminary enquiry revealed that the petitioner and the fourth respondent are claiming to be owners of the same land. The Surveyor who conducted the survey and fixed stones showed that on the complaint made by the fourth respondent only the survey was conducted. In view of the dispute relating to the land, it is for the petitioner to take appropriate civil proceedings in accordance with law. With the above observation, the Writ Petition is closed. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
