O R D E R

Aggrieved by the action of the 5th respondent - the Sub Registrar in insisting for production of 'No Objection certificate' for registering the house plot of the petitioner admeasuring 1547 sq.yards in S.No.58/1 of Tirupati Town in 19th ward near Indira Nagar , Tirupathi, Chittoor District, in spite of orders of this court in W.P.No.20687/2011 dated 7.11.2011 not to insist for the said certificate, the present writ petition has been filed. The learned Assistant Government Pleader produced written instructions stating that the lands in S.No.58/1A, 1F and 1G are endowment lands belonging to Tirumala Tirupati Devasthanam and if the land of the petitioner does not fall within the said survey number, the same may be directed to be registered.

In view of the above facts and circumstances and the submissions of the learned counsel, the writ petition is disposed of at the stage of admission, directing the 5th respondent - Sub Registrar, Tirupathi Urban, Tirupathi, to receive the document presented by the petitioner if the same is in order as per provisions of the Indian Stamp Act, 1899 and the Registration Act, 1908 and register the same. In case if he intends to refuse to register the said document, shall pass orders under Section 71 of the Registration Act, 1908 by recording reasons and shall communicate the same to the petitioner. No order as to costs.
