Heard Mr.N.Vinesh Raj, learned counsel for the applicant and Mr.Shireen Sethna Baria, learned counsel for the respondent.

2. This application has been filed under Section 11(5) &

(6) of the Arbitration and Conciliation Act, 1996 (briefly 'the Act' hereinafter) for appointment of sole arbitrator in terms of clause 16(b) of the lease deed dated O6.LO.2O|7.

3. Learned counsel for the respondent lairly submits that I I respondent would prefer the dispute between the parties to be , { resolved by way of arbitration.

4. As agreed to by the parties, Mr.K.Ajitha Simha Rao, District Judge (Retd.), LARRA, ccLA office premises, Nampally, Hyderabad, Ph.944o128299, a former District Judge of the state of Telangana is appointed as the sole arbitrator to arbitrate on the disputes between the parties. Learned counsel for the parties are also in agreement that Rules of International Arbitration and Mediation centre, Hyderabad shall govern the

arbitration in question. Parties may also avail the facilitiqs of the above centre for arbitration.

5. Let a copy of this order be furnished to the learned Arbitrator.

6. Parties shall appear before learned Arbitrator on 23.01.2023 at 11.00 A.M.

7. This disposes of the arbitration application. However, there shall be no order as to costs.
