THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.2441 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/A-1 in Crime No.2 of 2016 of Ananthapuram Mahila Police Station, Ananthapuram District for the offences punishable under Sections 498 A, 403, 506, 307 read with Section 34 IPC and Section 4 of Dowry Prohibition Act.

Heard the learned counsel for the petitioner/A-1 and the learned Public Prosecutor and perused the material available on record.

Admittedly, the 2nd respondent lodged a complaint against the petitioner, wherein specific allegations were made against the petitioner, the truth or otherwise of which can be ascertained only after due investigation into the crime by the investigating agency and the same cannot be determined at the threshold. Having regard to the facts and circumstances of the case and also in view of nature of offences alleged against the petitioner, this Court is not inclined to interfere with the proceedings against the petitioner/A-1. However, in view of the submission of the learned counsel for the petitioner that the petitioner/A-1 is apprehending of his arrest in view of pendency of the above crime, the Ananthapuram Police are directed to complete the investigation without arresting the petitioner/A-1 and file the final report in accordance with law. The petitioner/A-1 is directed to appear before the Investigating Agency as and when his presence is required and cooperate with the Investigating

Agency.

With the above direction, the Criminal Petition is dismissed. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
