HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Petition No.7900 of 2018 ORDER :
The petitioners are A.1 to A.4 of Cr.No.203 of 2018 dt.30.03.2018 for the occurrence of even date registered for the offences punishable under Section 306 IPC. The deceased is no other than brother-in-law of A.2 to A.4 and the husband of A.1 after his first wife's death he married the first petitioner/ A.1 as second wife. It appears, he performed the marriage of daughter through first wife by borrowal of some amount from his brother. The suicide note found during investigation discloses the accused persons threatened to do away with him unless parted with the property in the name of the first petitioner/ A.1 by engaging rowdy elements. It is that instigation that resulted in causing commission of suicide from the said note.
Having regard to the above, this Court is not inclined to consider the plea of anticipatory bail though duty of the Court is to balance the personal liberty with propensity of the crime and the propensity of the crime when compared with A.2 to A.4 is different from that of A.1 and it is not mentioned in the suicide note of such threats by A.1 only or otherwise tortured.
In the result, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this Criminal Petition, shall stand closed. __________________________ Dr. B. SIVA SANKARA RAO, J Date: 13.08.2018 Vvr
