HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2432 OF 2016 ORDER:

This criminal petition is filed, under Section 482 Cr.P.C., by the petitioners-A5 & A6 to quash the proceedings in CC.No.124 of 2015 on the file of the I-Additional Metropolitan Magistrate, Vijayawada, Krishna District, for the offences punishable under Sections 406, 420, 467, 468, 471 & 120B r/w.34 IPC.

Heard and perused the material available on record. It is alleged that the petitioners and other accused conspired together and made registrations in favour of LWs.2 to 39 by taking money from them and used for their personal purposes and defeated the interest of the de facto complainant company and caused loss to the company.

After arguing for some time, the learned Counsel for the petitioners submitted that the petitioners may be permitted to file discharge application and their presence before the trial Court may be dispensed with.

Considering the facts and circumstances of the case and the submission made by the learned Counsel for the petitioners, the petitioners are permitted to file discharge application before the trial Court and on such application being filed, the trial Court shall consider the same in accordance with law. Till the disposal of such discharge application, the presence of the petitioners before the trial Court is dispensed with.

With the above directions, the Criminal Petition is disposed of. Miscellaneous petitions pending if any, shall stand closed. ______________ RAJA ELANGO, J February 25, 2016.
