HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.26 of 2016 ORDER:

This petition is filed to withdraw O.P.No.1695 of 2015 from IV Additional District Judge cum Additional Family Court, Ranga Reddy District to Family Court, Mahbubnagar.

Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 26.02.2012 at Dasarapalli Village, Addakal Mandal, Mabubnagar District as per Hindu rites and caste customs.

Soon after the marriage, respondent started harassing her and due to harassment, she is now staying with her parents at Mahbubnagar. She stated that respondent filed O.P.No.1695/2015 before Family Court, Ranga Reddy and distance between Mahbubnagar and Ranga Reddy is about 100 km. She stated that she has no income and is completely depending on her parents for survival. She also stated that it is very inconvenient for her to defend the case at Ranga Reddy.

For these reasons, she prayed for transfer of O.P.No.1695 of 2015 from Family Court, Ranga Reddy to Family Court, Mahbubnagar.

This Court permitted petitioner to take out personal notice to respondent through her advocate on record in lower Court and in compliance of the said order, a memo is filed on 01.08.2016 stating that notice was sent to the counsel for the respondent in the lower Court and the same is received and filed postal acknowledgment. In spite of that, respondent neither appeared in person nor through any advocate.

Considering the reasons stated in the affidavit filed in support of this petition and also considering the convenience of

wife, O.P.No.1695 of 2015 is withdrawn from Family Court, Ranga Reddy, and transferred to Family Court, Mahbubnagar, for disposal in accordance with law.

6. Accordingly, transfer C.M.P. is ordered.
