ORDER

The petitioners, who are A1 to A3 in Cr.No.245/2015-16 of Prohibition and Excise Police Station, Narsipatnam,, registered for the offence punishable under Section 8(c) read with Section 20(b)(ii)(c) of NDPS Act, filed this petition under Section 439 of the Code of Criminal Procedure, 1973, seeking bail.

2. Heard both sides and perused the material on record.

3. It is alleged that the petitioners/A1 to A3 were arrested and taken into custody on 06.06.2015 at about 06.15 hrs., at Yetigairampeta bus stop of Golugonda Mandal, for possession of 120 Kgs of dry ganja in four gunny bags along with one Tata India Car and Rs.900/- cash by the Prohibition and Excise Sub-Inspector, Narsipatnam.

4. Since the petitioners/A1 to A3 were in possession of 120 Kgs of dry ganga, which is commercial quantity, this Court is not inclined to grant bail to them.

5. Hence, the Criminal Petition is dismissed. ________________ RAJA ELANGO, J.
