HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34647 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the 3rd respondent in summoning and calling the petitioners to the Kavali I Town Police Station, Kavali, Nellore District, without due process of law and without there being any case against the petitioners, as illegal and arbitrary.

Heard and perused the material available on record. 3.

The grievance of the petitioners is that though there is no written complaint against the petitioners, the 3rd respondent, under the guise of complaint lodged by wife of first petitioner, is calling to the police station and threatening and harassing him. 4.

Learned Assistant Government Pleader for Home submitted that the 3rd respondent is not intending to interfere with the affairs of the petitioners.

Considering the circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:

"The 3rd respondent is directed not to interfere with the affairs of the petitioners without there being any crime registered against the petitioners and without following due process of law. However, this order will not stand in the way of the 3rd respondent to investigate into the case, if any complaint is lodged against the petitioners, which discloses a cognizable offence."

There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. ____________________ RAJA ELANGO, J 17th October, 2016 Tsr
