CVNR, J CRP 4876/2017 ORDER:
The plaintiff in O.S. No.1236 of 2011 on the file of the Rent Control Court-cum- IV Additional Junior Civil Judge, FAC-III Additional Junior Civil Judge, Visakhapatnam, filed this revision petition, feeling aggrieved by order dt.12.6.2017 in I.A. No.284 of 2017 filed in the said suit.
Respondent Nos.1 to 5, who are defendant Nos.2 to 4 and 7 and 8 respectively in the aforementioned suit filed by the petitioner for perpetual injunction, filed the aforementioned I.A. for appointment of an Advocate Commissioner for measuring the width of the road shown as western boundary in the suit schedule property. By the impugned order, which does not measure to the standard expected of a Junior Civil Judge, the Court below has allowed the said application. While I agree with Mr. N. Ashwani Kumar, learned counsel for the petitioner, that the order under revision is shorn of any reasons, I am, however, not inclined to interfere with the said order as the petitioner, who is the plaintiff, has not pleaded, much less proved, any prejudice on account of the appointment of an Advocate Commissioner.
The civil revision petition is accordingly dismissed. As a sequel to dismissal of the civil revision petition, C.R.P.M.P. No.6347 of 2017 shall stand disposed of as infructuous. _______________________ C.V. NAGARJUNA REDDY, J 22-09-2017 bnr
