THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.12014 OF 2025 ORDER :
This criminal petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused seeking enlargement on bail in connection with Crime No.136 of 2025 of Bellampalli I-Town Police Station, Ramagundam Commissionerate, Mancherial District. The offences alleged against the petitioner are under Section 109(1), 115(2), 296 (b) and 351(2) of Bharatiya Nyaya Sanhita, 2023.

The case of the prosecution is that on 26.08.2025 at 13.30 hours the complainant lodged a complaint stating that he is Vadrangi by caste and working at Dattatreya Medical Shop, Budidhagadda Basthi. It is stated that on the same day at about 12:20 hours, the accused arrived on a motorcycle and called the complainant outside the shop, stating that he should stop demanding money from one Tirupathi as it was causing family disputes. The accused further threatened that if he kills the complainant, there would be no further demands. He then allegedly hit the complainant on his head with a stone, causing bleeding injuries. He also punched him on the face, and put his leg on the complainant's throat, obstructing his breathing with intent to kill him. Hence, he requested the police for necessary
- 2 - action against the accused. Basing on the said complaint, the police registered the case against the accused for the above offences.

Heard Sri K. Venumadhav, learned counsel for the petitioner and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.
The contention of learned counsel for the petitioner is that there is no allegation that petitioner is having any intention to kill the complainant, the police registered the FIR for the offence under Section 109(1) of BNS and while remanding him to judicial custody on 27.08.2025, the other offences were shown which clearly shows that the allegations constitute only causing of hurt and nuisance. Further, the dispute of money transaction is between the complainant and the friend of petitioner and he has nothing to do with the same. The petitioner was arrested and remanded to judicial custody on 27.08.2025 and most of the investigation is completed. As such, requested this Court to grant bail to the petitioner. 5.
On the other hand, learned Additional Public Prosecutor opposed bail stating that petitioner intentionally beat the complainant with stone causing bleeding injuries with an
- 3 - intention to kill him. The complainant is still undergoing treatment and there is life threat to the complainant in the hands of petitioner. The petitioner is also involved in other offences and he is a habitual offender and the medical certificate of the injured is awaited. Hence, he prayed this Court to dismiss this petition.

Considering the submissions made by the respective counsel and the material placed on record the petitioner herein is remanded to judicial custody on 27.08.2025 and as seen from the record, Lws.1 to 9 are examined. The only contention of learned Additional Public Prosecutor is that there are six cases pending against this petitioner and as seen from the record and remand report, three cases are already disposed of and three cases are pending. Considering the incarceration of petitioner in jail and the progress in investigation, this Court deems it fit to grant bail to the petitioner subject to the following conditions: i.
The petitioner/Accused shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate at Bellampalli, Mancherial District.
ii.
The petitioner/Accused shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

The petitioner/Accused shall abide by the conditions stipulated in Section 483(2) of BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
