HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.24781 OF 2017 ORDER:

Heard learned counsel for petitioner and learned Government Pleader for respondents.

The petitioner was appointed as fair price shop dealer of shop No.36 of Chinthalapeta, H/o Kocheruvu Village, Dhone Mandal, Kurnool District, in the year 2004. While so, on 23.09.2014, he was served with a show cause notice by the third respondent levelling certain charges against the petitioner. He submitted his explanation and when an order of cancellation was passed without considering the explanation, the petitioner filed W.P.No.25654 of 2015 and the same was allowed on 31.08.2015 by setting aside the order of cancellation and remanded the matter to the third respondent. When the third respondent passed another order of cancellation without complying the orders of this Court, the petitioner again filed W.P.No.42028 of 2015 and this Court by order dated 18.02.

2016, allowed the writ petition by directing the District Collector to conduct enquiry by another incumbent officer. Now when the fourth respondent passed an order of cancellation of authorisation on 07.06.2017, the present writ petition is filed. Against the order of cancellation, the petitioner filed an Appeal before the second respondent along with stay petition on 10.07.2017 and the stay petition is not yet disposed of. Be that as it may, since almost one month had elapsed, the second respondent is directed to consider the Appeal itself and dispose of the same within a period of two months from the date of receipt of a copy of this order, after giving due opportunity to the petitioner.
