THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2151 OF 2015 ORDER:
The present criminal revision case is filed by the petitioner challenging the order, dated 30.04.2015, passed in Criminal Revision Petition No.86 of 2014 on the file of the Court of the II Additional District and Sessions Judge, Madanapalle, Chittoor District, whereby the lower appellate Court modified the order, dated 30.10.2014, passed in M.C.No.11 of 2009 by the Court of the II Additional Judicial Magistrate of First Class, Madanapalli, by enhancing the maintenance amount from Rs.2,000/- (Rupees two thousand only) to Rs.3,000/- (Rupees three thousand only) payable to the second respondent herein. Heard and perused the records.
Learned counsel for the petitioner submitted that the petitioner herein is unable to pay the maintenance amount of Rs.3,000/- per month to the second respondent herein as ordered by the Court below and as such, prays this Court to reduce the maintenance amount.
This Court is of the view that the lower appellate Court has rightly enhanced the maintenance amount of Rs.3,000/- (Rupees three thousand only) on appreciation of evidence and as such, needs no interference by this Court. The trial Court is directed to dispose of M.C.Nos.11 of 2009 and 18 of 2010, as expeditiously as possible, preferably within a period of three months from the date of receipt of this order.
With the above direction, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed.
