THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO CONTEMPT CASE NO. 487 OF 2013 ORDER:
Sri L. Ravichander, learned Senior Counsel would submit candidly that the order passed by this Court on 11.02.2013 has not been complied with by filing the photographs of the constructions made thus far before the Registrar of this Court within the stipulated time, but however, the photographs together with the necessary undertaking has been filed before the Registrar on 12.04.2013. Sri P. Raghavender Reddy, learned counsel for the petitioner would urge that without complying with the Court order, inspite of knowing its contents, the respondent in this contempt case proceeded further and carried on constructions and almost completed the same, whereas the learned Senior Counsel would submit that the constructions were standing as it is as they were nearly 2 years back.
More importantly, the learned Senior Counsel would submit that no further construction activity is being undertaken by the respondent. In that view of the matter, though the respondent herein has not complied with the Court order, I prefer to extend benefit of doubt and not proceed any further in this contempt case and it is accordingly dismissed.
