This Criminal Petition is filed by the petitioners/A-1 and A-2 under Sections 437 & 439 of the Code of Criminal Procedure, 1973 seeking to grant bail in N.S.C.No.67 of 2016 on the file of the Metropolitan Sessions Judge, Visakhapatnam in Crime No.122 of 2015 of V.Madugula Police Station, registered for the offences punishable under Section 20(b)(i) read with Section 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. Heard and perused the material available on record. Case of the prosecution is that on 1.12.2015, the petitioners herein were found transporting 220 kgs. of ganja illegally. Learned counsel for the petitioners submitted that the petitioners are innocent of the offences alleged against them and they have been falsely implicated in the present case. The petitioners were arrested on 1.12.2015. The petitioners were found in possession of 220 kgs. of ganja. Since the ganja found is more than the commercial quantity and considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioners.
