THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION Nos.9613, 9614 AND 9709 OF 2016 COMMON ORDER:

Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor. Perused the material on record.

2. Since the petitioners in all the Criminal Petitions are one and the same, these Criminal Petitions are being disposed of by Common Order.

3. Criminal Petition Nos.9613, 9614 and 9709 of 2016 are filed by the petitioners/A.1 and A.6, under Sections 437 and 439 of the Code of Criminal Procedure, 1973, seeking enlargement on bail in Crime No.204 of 2015 of Thipparthy Police Station and in Crime Nos.227 and 177 of 2015 of Narketpally Police Station, Nalgonda District, registered for the offence punishable under Section 379 IPC.

4. The case of the prosecution is that in the year 2015, petitioner No.1/A.1 along with others committed theft of valuable goods and handed over the same to petitioner No.2/A.6, who disposed of the same at Hyderabad. On 16.03.2015 at 0:15 hours, A.1 was apprehended along with part of the stolen party and in pursuance of his confession, A.6 and other accused were apprehended and sent to judicial custody.

5. Learned counsel for the petitioners submits that in all the cases, police have completed investigation and also filed charge sheets and hence requests for grant of bail to the petitioners.

6. On the other hand, learned Additional Public Prosecutor, on

instructions, opposed the same stating that the petitioners are habitual offenders and they are involved in 29 cases of similar nature; that if the petitioners are released on bail, there is every likelihood of delay in process of trial, since they are residents of Rajasthan State.

7. Having regard to the circumstances stated above, filing of charge sheets may not be a ground to grant bail to the petitioners. Since the petitioners are involved in 29 cases and as there is likelihood of they evading the process of law if released on bail, I am not inclined to grant bail to the petitioners.
