Judgment: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) The Singareni Collieries Company Limited filed this appeal against order and decree dated 22.12.1999 in O.P.No.106 of 1997 on the file of the Senior Civil Judge, Peddapally, whereunder, he has enhanced compensation from Rs.11,000/- to Rs.45,000/- for Category-I lands, from Rs.15,000/- to Rs.57,000/- for Category-II and III lands and from Rs.35,294/- to Rs.57,000/- for Category-IV lands, apart from increasing the value of wells from Rs.2.47,462/- to Rs.4,94,924/- and that of trees from Rs.2225/- to Rs.6675/-. 2.

At the hearing, the learned counsel for both the parties submitted that the appeal and cross objections are referred to Lok Adalat, which passed different Awards, including Awards dated 12.11.2010 and dated 27.09.2016. It is agreed by the learned Standing Counsel for Singareni Collieries, the appellant and the learned counsel for respondent No.245, who came on record as the legal representative of respondent No.134, that the dispute has been settled by the Lok Adalat Awards, qua several other respondents also. It is also agreed by the learned counsel for both the parties that under the Lok Adalat Awards, the parties have agreed for market value @ Rs.70,000/- per acre for wet lands and @ Rs.65,000/- per acre for dry lands.

In the light of the Awards dated 12.11.2010 and 27.09.2016, the appeal and cross objections shall stand disposed of to the extent they pertain to respondent No.245 (legal representative of respondent No.134), by fixing the market value of wet lands @ Rs.70,000/- per acre and that of dry lands @ Rs.65,000/- per acre. ______________________ (C.V.Nagarjuna Reddy, J) _____________________ (Gudiseva Shyam Prasad,J) Date: 04th October, 2018 msb
