THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO AND THE HON'BLE MRS. JUSTICE ANIS WRIT PETITION No. 33423 OF 2015 O R D E R: (per Hon'ble Sri Justice Nooty Ramamohana Rao) The grievance of the petitioner herein is that notwithstanding the interlocutory relief granted by the Andhra Pradesh Administrative Tribunal, Hyderabad in O.A.No. 5411 of 2015, the respondents are acting contrary thereto. The reason for this allegation is that the name of the petitioner/applicant before the Tribunal is included in the list of teachers, who are likely or liable to be transferred. That, according to the learned counsel for the petitioner, is upon a premises that the school where the petitioner is presently working does not have adequate pupil ratio and for working out the said pupil ratio, the respondent authorities are taking into account only such of those students, who produce the necessary Aadhar card, whereas there are several other students in the school, who do not possess the Aadhar card unique identification number.

Learned Government Pleader for Services (Andhra Pradesh) made it very clear that the State is conscious of its obligations and while trying to rationalize, the State would conduct its business strictly in terms of the rules and regulations framed governing the subject. This apart, the petitioner has already completed more than four years of stay at the present place and hence, his name is only included for a possible transfer, in accordance with the scheme formulated by the State Government.

In view of the statement made by the learned Government Pleader that the State is going to conduct its affairs strictly in accordance with the legal regime, we find that the apprehensions entertained by the petitioner that the respondents will be acting contrary and in breach of the interlocutory relief granted by the Tribunal can only be imaginary for the present.

Therefore, preserving all such rights, which are available to the petitioner, this Writ Petition stands dismissed. No costs.

Consequently, the miscellaneous applications, if any shall also stand

dismissed.
